1.- Purpose
These General Terms and Conditions of Service Provision (hereinafter, General Conditions) apply to all orders requested from Traductor Jurado La Gomera through its legal entity Royal Elba SL by the Client and constitute a legally binding agreement between the Client and Royal Elba SL regarding the provision of translation and apostille services.
Should the parties expressly agree to work under Specific Conditions, the provisions of such Specific Conditions shall prevail over those conflicting with these General Conditions, while the remaining provisions shall remain unaffected. The possible invalidity of any provision shall not affect the validity of the remaining provisions.
The Client’s own General Conditions shall only apply after express written acceptance by Royal Elba SL.
From the acceptance of the quotation, the Client shall be deemed to accept the General Conditions without the need for further confirmation, unless changes are made within the established period. In such case, the General Conditions shall again be provided to the Client for acceptance.
The use of the web platform made available by Royal Elba SL and the submission of Original Material by the Client imply acceptance by the Client of all the General Conditions.
2.- Definitions
– Traductor Jurado La Gomera: refers to the website brand www.traductorjuradolagomera.com.es, a translation company managed by Royal Elba SL.
– Royal Elba SL: refers to any of the brands of Royal Elba SL, as well as its internal employees and authorised external collaborators.
– Client: refers to the person, company, organisation, etc., who commissions or pays for the work, or the person authorised to represent such company or organisation.
– Sworn Translation: refers to the translation and certification carried out by a sworn translator certified by the MAEC or the corresponding authority in each case. Sworn translation work is performed by a single professional sworn translator and includes a self-review by the same sworn translator. It does not include a review by a different professional translator.
– Translation: refers to the transfer of a message from a Source Language into an equivalent message in a Target Language, according to professional standards and practices.
– Sworn Translator: refers to the internal employee or external collaborator of Royal Elba SL responsible for carrying out the sworn translation. The sworn translator is certified by the MAEC or the corresponding authority in each case.
– Source Language: refers to the language in which the Original Material is written.
– Target Language: refers to the language into which the content of the Original Material must be translated, resulting in Final Material.
– Original Material: refers to the documents and other material delivered to Royal Elba SL for the provision of sworn translation services in accordance with these Conditions.
– Final Material: refers to the final translated and certified version of the Original Material.
– Urgent: refers to orders whose delivery deadline is expressly identified as Urgent courier delivery.
3.- Quotations
The quotation provided by Royal Elba SL is free of charge and without obligation.
During the quotation phase, the Client must provide Royal Elba SL with the necessary information for the correct preparation of the quotation (Source Language, Target Language, type of document, number of additional copies, etc.).
The quotation provided by Royal Elba SL includes:
- The sworn translation service, including the sworn translation itself, certification, signature and corresponding official stamp;
- The type of document;
- The language combination of the order;
- The number of requested copies;
- The total cost of the order;
- Discounts, fees and taxes. Unless explicitly stated otherwise, quotations include IGIC, which shall be itemised at the end of the order and applied on the corresponding invoice;
- The approximate delivery date of the order.
4.- Prices and Rates
Unless specifically stated otherwise, prices include taxes but do not include shipping costs. Shipping costs, where applicable, will be indicated in the quotation.
Royal Elba SL shall provide the agreed service and invoice it according to the terms and prices specified in the quotation.
Promotional offers cannot be combined with each other or with other discounts.
Offers and quotations provided by Royal Elba SL are valid only at the time they are issued and shall not be considered binding unless expressly stated otherwise. Unused discounts offered by Royal Elba SL may be cancelled unilaterally without prior notice. Discounts only apply at the moment the Order is placed and shall not be applied afterwards.
Royal Elba SL reserves the right to modify prices, rates and estimated delivery dates indicated in previous quotations. Royal Elba SL shall inform the Client of any new proposed costs or delivery dates before completing the Order.
Before starting any work, we always verify prices and deadlines as part of our processing procedure.
5.- Order
All orders shall be confirmed upon acceptance of the quotation and full advance payment by the Client, and must include all information necessary for the correct provision of the requested service.
If the Client fails to inform Royal Elba SL of any important aspects of the service, the Client shall not be entitled to claim any discount or compensation regarding possible deficiencies or delays arising therefrom.
The delivery deadline specified in the quotation is approximate and based on the assumption that payment will be made immediately after acceptance. If payment is not received immediately, delays in production, shipment and delivery may occur.
Royal Elba SL shall not be responsible for delays caused by late payment by the Client.
If Royal Elba SL does not receive full payment of the amount indicated in the quotation, Royal Elba SL reserves the right not to start the Order until full payment has been received.
If Royal Elba SL cannot carry out the Order under the conditions indicated in the quotation due to obvious errors in dates or costs, the Client shall be informed as soon as possible by email and the Order shall not be processed. If payment has already been made, the amount shall be refunded as soon as possible.
6.- Service Provision
The Client declares and guarantees that: a) the Original Material belongs to them or they are authorised to use or transmit it; and b) the translation of the Original Material and the publication, distribution, sale or any other use of the Final Material shall not infringe copyrights, trademarks, patents, confidentiality or any third-party rights.
The Service includes Translation, Sworn Translation, Apostille and delivery according to the method agreed in the quotation.
When non-editable Original Material is received, delivery shall be made in a format as similar as possible to the Original Material, at the discretion of the sworn translator responsible for the Order.
The Order shall be considered completed upon delivery of the sworn translation in PDF or paper format (as requested by the Client), duly certified, signed and stamped by the corresponding sworn translator.
The Client is specifically informed that, in Spain, the only legally valid versions are those delivered in paper format bearing the original signature, stamp and certification of the sworn translator.
7.- Delivery Times
For any delivery method offered by Royal Elba SL, the delivery deadline indicated in the Order is approximate. Royal Elba SL shall make every effort and use all reasonable means to comply with the agreed delivery method and deadline.
If Royal Elba SL is unable to meet the proposed delivery deadline, the Client shall be informed as soon as reasonably possible and a new delivery deadline shall be agreed upon.
Delivery shall be deemed completed when it can be demonstrably proven according to the agreed delivery method and location.
The delivery deadline shall be considered breached only when delivery is delayed by more than 48 hours due exclusively and directly to causes attributable to Royal Elba SL.
Royal Elba SL shall under no circumstances be responsible for delays caused by force majeure, illness, accidents, courier companies, technical failures, or circumstances beyond its control.
Royal Elba SL also offers collection from its office located at Calle Hermano Pedro 7, Local 2, 38670 Adeje, Santa Cruz de Tenerife.
8.- Modification/Cancellation of the Order
8.1.- Modifications or Additions to the Original Material
If the Client requests modifications or additions to the Original Material during the execution of the Order, the Client must immediately provide Royal Elba SL with clear written instructions regarding the changes and their location in relation to the previously submitted copy.
Royal Elba SL shall inform the Client as soon as possible about the impact on costs and deadlines resulting from the requested modifications or additions.
The Client shall bear the cost of such modifications or additions.
8.2.- Order Cancellation
The Client may cancel the Order only if production has not yet started.
Orders already in production cannot be cancelled.
9.- Service Quality
Royal Elba SL shall provide services according to professional standards and with maximum fidelity to the original text.
Royal Elba SL declines responsibility for ambiguities, errors or inconsistencies contained in the Original Material.
10.- Complaints
Any complaint regarding the Service must be submitted in writing within thirty (30) calendar days from delivery.
If justified, Royal Elba SL shall review and correct the translation free of charge.
11.- Translation Errors
The following shall be considered translation errors:
- Serious grammatical or spelling mistakes.
- Untranslated text fragments.
- Translations with clearly incorrect meanings.
The following shall not be considered translation errors:
- Typographical errors.
- Stylistic preferences.
- Ambiguities present in the Original Material.
- Terminology disagreements unless the Client provided precise instructions.
12.- Limitation of Liability
Royal Elba SL exclusively provides sworn translations in accordance with applicable Spanish legislation.
Royal Elba SL does not guarantee acceptance of sworn translations by third parties for reasons beyond its control.
Royal Elba SL’s liability shall in all cases be limited to the total amount paid for the Order.
13.- Payment Terms and Methods
The Client placing the Order shall be solely responsible for payment of the contracted services.
Invoices shall be issued electronically in PDF format and shall include applicable taxes and charges.
Payments may be made by card, Bizum, bank transfer or cash unless otherwise agreed.
Late payments may incur penalties and administrative charges according to Spanish legislation.
14.- Ownership, Property and Usage Rights
All ownership and usage rights shall remain with Royal Elba SL until full payment has been made.
15.- Confidentiality
Royal Elba SL undertakes to maintain confidentiality regarding all information received before, during and after service provision.
All collaborators and employees are subject to confidentiality obligations.
The confidentiality obligation shall remain valid after termination of the contractual relationship.
16.- Data Protection
In accordance with applicable legislation, the Client’s personal data shall be processed for the management of contracted services and related administrative activities.
The Client may exercise their rights of access, rectification, deletion and objection by contacting Royal Elba SL.
17.- Modifications to the General Terms and Conditions
Royal Elba SL reserves the right to modify these General Terms and Conditions at any time without prior notice.

19.- Applicable Law and Jurisdiction
These General Terms and Conditions shall be governed by Spanish law.
Royal Elba SL and the Client expressly submit to the jurisdiction of the Courts and Tribunals of Adeje (Spain).
